Who we are
Gildeas Solicitors is a Scottish firm of solicitors regulated by the Law Society of Scotland. Motorcycle Accident Claims Scotland is the public-facing brand for our motorcycle injury practice, led by Stephen Hay (Director).

What we collect
When you contact us — by phone, email, the website form, or in person — we collect the information you give us so we can advise on your claim. That typically includes your name, contact details, the circumstances of the accident, injuries sustained, and any documents you choose to send.
If we take on your case, we will collect further information needed to run it: medical records, police reports, insurance correspondence, employer information for loss-of-earnings calculations, and (where relevant) bank details for paying out compensation.
Why we use it & lawful basis
We use your information for one purpose: to provide legal services. The lawful basis under UK GDPR is performance of a contract (your retainer with us) and, where relevant, our legitimate interests in operating a regulated legal practice.
Health and injury data is special category data. We process it on the basis of Article 9(2)(f) — establishment, exercise or defence of legal claims — which is the standard basis for personal injury solicitors.
How long we keep it
Active client files are kept for the duration of the case. After the case closes, files are retained for the period required by the Law Society of Scotland and our professional indemnity insurer — typically a minimum of ten years for personal injury matters, longer for cases involving children or fatal accidents. After the retention period, files are securely destroyed.
Your rights
Under UK GDPR you have the right to: access the data we hold about you; correct inaccurate data; ask us to delete data (subject to our legal retention duties); restrict or object to processing; and complain to the Information Commissioner's Office.

Complaints
If you are unhappy with how we have handled your data, you can complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113. We would prefer the opportunity to put things right first — please ring or email us before escalating.
